### SECTION 1 - COTTAGE FOOD OPERATIONS & COMPLIANCE (TEXAS)
All food items offered by Spellbound Crumbs are prepared and packaged in a home kitchen that is not regulated or inspected by the Texas Department of State Health Services or local health authorities. All items are produced and sold strictly in accordance with the Texas Cottage Food Law. By purchasing, you acknowledge that you understand the nature of our cottage baking operation.
### SECTION 2 - MANUAL PAYMENTS & ORDER PROCESSING
We utilize manual, peer-to-peer payment methods, including but not limited to Venmo, Zelle, and CashApp.
* **Payment Clearance:** Orders are not officially accepted, placed on our baking schedule, or processed until your full payment transfer has cleared our accounts.
* **Time Limitation:** Payment must be submitted within one (1) hour of checking out on the Site. If payment is not verified within this window, your order reservation will be automatically cancelled to free up kitchen production availability.
* **Identification:** You must include your Shopify Order Number in the payment memo field of your transfer app so we can successfully match your payment to your box.
### SECTION 3 - PERISHABLE GOODS ABANDONMENT
Because our signature massive 4 oz cookies and custom decorated treats are freshly baked, perishable food items, pickup or delivery windows must be strictly adhered to by the customer.
* Orders not claimed within twenty-four (24) hours of your confirmed, scheduled fulfillment slot will be safely discarded due to food spoilage safety standards.
* In the event of abandonment, the customer completely forfeits the order total. No refunds, partial refunds, or store credits will be issued for abandoned goods.
### SECTION 4 - NO REFUNDS & ALL SALES FINAL
Due to the custom-made and perishable nature of our products, all sales are final. For public safety and health quality assurance, we do not accept physical returns or exchanges of food items under any circumstances.
* **Modifications & Cancellations:** Requests to cancel or modify a scheduled order must be submitted via text or email at least ninety-six hours (96) hours prior to your scheduled fulfillment window. Anything requested past this window cannot be accommodated or refunded.
* **Fulfillment Discrepancies:** If we make a clear operational error on your order (such as providing an incorrect box size or missing structural flavor selections), you must contact us with a clear photograph within two (2) hours of receipt. We will evaluate issues on a case-by-case basis to provide a mutually acceptable resolution via store credit or a replacement bake slot.
### SECTION 5 - ALLERGEN WARNING
Our products are made in a home facility that handles common food allergens, including but not limited to wheat, gluten, eggs, dairy, tree nuts, peanuts, and soy. We cannot guarantee an allergen-free baking environment. It is the customer's sole responsibility to notify their consumers of potential allergen exposure.
### SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email or phone number provided at the time the order was made.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website.
